3. Service Description

Brandify provides AI-powered image and content generation software that allows users to create, share, and embed graphic templates that comply with brand design guidelines. Our services include:

• Custom template creation
• Multi-design generation from single form inputs
• Responsive environment customization
• Email automation for task actions and form submissions
• File generation in multiple formats (Images, PDF files, with Video coming soon)

4. User Accounts and Eligibility

• You must be at least 18 years old to use our services.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities occurring under your account.
• We reserve the right to suspend or terminate accounts that violate these terms.
• You must provide accurate and complete information when creating an account.

5. Subscription and Payment Terms

5.1 Subscription Plans

• Free Trial: 7-day free trial available for new users
• Annual Subscription: BD10/Year

5.2 Package Tiers

• Bronze: BD5 (50 Render Credits + 10 Free, up to 1 free template)
• Silver: BD10 (100 Render Credits + 20 Free, up to 2 free templates)
• Gold: BD15 (150 Render Credits + 30 Free, up to 3 free templates)
• Platinum: Custom pricing (200+ Render Credits, up to 5 free templates)

5.3 Template Pricing

• Basic Template: BD10 (1 Template)
• Advanced Template: BD20 (1 Template with more than 6 inputs, dynamic elements, conditions)
• PDF Template: BD15 (1 Page, unlimited inputs, dynamic inputs, Google Sheet integration)

5.4 Payment Methods

• We accept major credit cards and local payment methods.
• All payments must be made in advance of service provision.
• All prices are listed in Bahraini Dinar (BD).

5.5 Render Credits

• Render Credits are consumed when generating images or files.
• Credit consumption varies based on complexity and output format.
• Credits expire 12 months from the date of purchase if unused.

6. License Terms for Generated Content

6.1 Ownership of Generated Content

• You retain ownership of the content you create using our service.
• Brandify retains ownership of the technology, algorithms, and template systems.

6.2 Usage Rights

• Content generated under paid plans may be used for commercial and non-commercial purposes.
• Content generated under free trials or free templates may be used for personal use only.
• Brandify reserves the right to use generated content for promotional purposes unless explicitly opted out.

7. Prohibited Uses

You agree not to use Brandify to:

• Generate content that infringes upon intellectual property rights of others
• Create defamatory, discriminatory, or unlawful content
• Distribute malicious software or harmful content
• Impersonate others or misrepresent your affiliation
• Generate content that promotes illegal activities
• Attempt to reverse engineer or decompile the software
• Exceed reasonable usage limits that may impact system performance

8. Refund Policy

• Subscription Fees: Refundable within 7 days of purchase if service is unusable due to technical issues not caused by the user.
• Template Purchase: Non-refundable once the template has been delivered and implemented.
• Render Credits: Non-refundable once purchased.

9. Service Availability and Maintenance

• We strive to maintain 99% uptime but do not guarantee uninterrupted service.
• Scheduled maintenance will be announced at least 24 hours in advance when possible.
• Emergency maintenance may occur without prior notice.
• Brandify is not liable for service interruptions caused by factors beyond our control.

10. Intellectual Property Rights

• Brandify and its licensors own all intellectual property rights to the service and software.
• Templates provided by Brandify remain the property of Brandify unless specified otherwise.
• You may not copy, modify, distribute, or create derivative works based on our service without explicit permission.

11. Custom Templates

• Custom templates created for clients are licensed exclusively to the client.
• Brandify retains the right to the underlying technology and methods used to create custom templates.
• Development timeframes for custom templates vary based on complexity.

12. Data Privacy

• We collect and process personal data as described in our Privacy Policy.
• You retain ownership of the data you provide to our service.
• We may use anonymized data for service improvement purposes.

13. Limitation of Liability

• Brandify shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claims is limited to the amount paid by you for the service in the 12 months preceding the claim.
• We provide the service "as is" without warranties of any kind.

14. Termination

• Either party may terminate this agreement at any time.
• Upon termination, you lose access to the service and any unused credits.
• Sections regarding ownership, liability, and governing law survive termination.

15. Changes to Terms

• Brandify reserves the right to modify these terms at any time.
• Changes will be effective immediately upon posting to our website.
• Continued use of the service after changes constitutes acceptance of the revised terms.

16. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Bahrain. Any disputes arising out of or relating to these terms shall be resolved in accordance with Bahrain law.
